General Terms for the Rental Agreement for Motorcycles and Scooters
The motorcycle is rented on the terms stated in the rental agreement and on the basis of the following provisions, which the renter expressly acknowledges as binding contractual content by signing. Oral agreements are void and will not be recognised.
1.Handover of the rental motorcycle
The renter acknowledges that the rental motorcycle is in good external condition, in a roadworthy state and free of obvious damage. The renter undertakes to inspect the rental vehicle for any defects upon takeover and to record them in the agreement. After return of the rental vehicle, no subsequent complaints by the lessor will be accepted. The lessor is and remains the owner of the rental vehicle.
2. Rental rate
The rental rate, including insurance, together with the deposit set by the lessor, is payable in advance. Any extra kilometre charges (CHF 0.25) are payable afterwards and will be offset against the deposit.
3. Insurance and vehicle tax
The rental vehicle is covered by statutory third-party liability insurance. This covers personal injury and property damage to third parties within the statutory cover limits. The rental price includes accident insurance covering both the rider and the pillion passenger against the consequences of accidents. The terms of the insurance policy taken out by the lessor apply.
4. Care of the vehicle
The rental motorcycle must be cared for and maintained according to the lessor’s instructions. Brake function and general roadworthiness must be checked before every ride. The vehicle must be operated and ridden carefully and conscientiously.
5. Use and authorisation to ride the rental vehicle
The rented vehicle may only be ridden by the renter or by a person entered in the rental agreement as an “additional rider”. Riding in rough terrain (off-road), on motocross tracks or on racetracks is not permitted. Participation in further-training courses and instructor courses requires prior declaration and may result in a higher rental price. No parts may be fitted, removed or replaced. Commercial transport of persons or goods is permitted, but the lessor must be informed in advance.
6. Repairs and maintenance
In Switzerland and abroad, repair and maintenance work may only be carried out with the lessor’s consent by official brand dealers. See the rental agreement for the emergency number. Breakdowns may only be handled by the official breakdown service included in the rental, or by official brand dealers. If the renter has such work carried out by other persons, the renter bears the costs. The renter may not claim charging, fuel, cleaning, towing, replacement vehicle or any other expenses or costs.
7. Accident, theft and other claims, and fines
All claims must be reported to the lessor immediately. A claim form must be completed in every case. See the rental agreement for the emergency number. Excesses under the comprehensive (casco / fully comprehensive) insurance, including handling and other costs (lump sum), apply per claim as set out in the current rental price list. The third-party liability excess is the amount under the insurance policy in force; the standard amount is CHF 500.
The lessor reserves the right to charge the renter a lump sum of CHF 500 for handling. For forwarding traffic offences (reports or fines), the lessor charges a fee of CHF 40. For damage to the rental vehicle that the lessor did not notice or that the renter concealed, and that is discovered after settlement, the lessor may still hold the renter liable until the next rental. The lessor must notify the renter of such damage immediately after discovery by registered letter.
8. Return of the rental motorcycle
The renter undertakes to return the motorcycle to the lessor at the agreed time, in impeccable condition, with all documents and accessories, cleaned and with the same state of charge, at the agreed location. If the lessor has to recharge the vehicle, charging costs plus a processing fee of CHF 25 will be charged. Cancellation or extension of the rental must be made at least 48 hours before the start or end of the contractual rental period. If the vehicle is not returned at the agreed time, or if the deposit does not cover the actual rental, the rental agreement ends automatically immediately without prior written notice. The renter is liable for all resulting costs and losses, including rent, lost follow-on rentals, etc.
9. Breach of contract / final provisions
In the event of a breach of contract, the renter shall bear the resulting costs. Oral side agreements are invalid. Any right of retention of the renter over the motorcycle for any reason is excluded. Rental applications may be refused without stating reasons. In addition, the terms of the insurance taken out for this vehicle apply. The place of jurisdiction is the respective registered location of RYDR GmbH.
